1. Scope & acceptance
These Terms form a binding agreement between you and Hong Kong Dasitaike Electronics Technology Co., Limited. They apply to:
- Our corporate website at dasitktech.com and any sub-domain (the "Website").
- Our mobile applications published on Google Play and the Apple App Store (the "Apps").
- Our consumer electronics, wholesale, retail, import/export, R&D and technical consulting services (the "Services").
- All associated features, content, software and documentation made available by Dasitaike.
By accessing the Website, downloading or installing an App, creating an account, requesting a quote, or otherwise using the Services, you confirm that you have read, understood and agreed to these Terms and to our Privacy Policy. If you are accepting on behalf of an organization, you represent that you have authority to bind that organization, in which case "you" refers to that organization.
2. Eligibility & age
You must be at least the age of digital consent in your jurisdiction to use the Services. Specifically:
- 13 years or older — in the United States (COPPA), Hong Kong, Taiwan, South Korea, and most other jurisdictions not listed below.
- 14 years or older — in the European Union, the United Kingdom, Cyprus, the Netherlands, Slovenia, and (for direct marketing / information society services) several other EU member states, as well as in mainland China (PIPL).
- 16 years or older — in certain EU member states (Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden) where the Member State has set the default age of digital consent to 16.
- 18 years or older — to enter into a binding contract. If you are below 18 but above the age of digital consent, you confirm that you have the consent of a parent or legal guardian.
- 21 years or older — in jurisdictions where majority is set at 21, to enter into certain regulated contracts.
For business accounts, the person accepting these Terms represents that they are authorized to bind the entity and that the entity is duly organized and in good standing in its jurisdiction.
For our mobile applications published on the Apple App Store, the age you enter in the Apple ID may be used as the primary age signal. For apps published on Google Play, the Google account age is used. If the App is set as a "Designed for Families" app on Google Play, the age rules in Section 16 apply.
3. Account & registration
To access certain features, you may need to create an account. When you do, you agree to:
- Provide accurate, current and complete information.
- Keep your information updated.
- Maintain the security of your account, password and any device you use to access the Services.
- Promptly notify us of any unauthorized use of your account.
- Take responsibility for all activities that occur under your account, whether or not you authorized them.
We may suspend, limit or terminate your account if we reasonably believe that you have violated these Terms or if required to do so by law or by an app store.
4. License to use
Subject to your compliance with these Terms, Dasitaike grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, internal business or authorized reseller purposes, as applicable. This license does not include the right to:
- Resell, sublicense or commercially exploit the Services except as expressly permitted by a written agreement with Dasitaike.
- Use the Services to build a competing product or service.
- Reverse engineer, decompile, or otherwise attempt to derive source code, except to the extent expressly permitted by applicable law.
- Remove, alter or obscure any copyright, trademark or other proprietary notices.
5. Restrictions
You agree not to, and not to authorize any third party to:
- Use the Services for any unlawful purpose or in violation of any applicable laws or regulations.
- Upload, post, transmit or otherwise make available any content that is illegal, infringing, defamatory, obscene, harassing, hateful, racially or ethnically offensive, or that encourages violence or illegal conduct.
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Interfere with or disrupt the Services, our servers, or any networks connected to the Services.
- Use any robot, spider, scraper or other automated means to access the Services for any purpose without our express prior written consent, except for the purpose of legitimate search engine indexing of publicly available pages.
- Attempt to gain unauthorized access to any portion of the Services, other accounts, computer systems or networks connected to the Services.
- Use the Services to send unsolicited communications, promotions, advertisements or spam.
- Use the Services in a way that could damage, disable, overburden or impair our infrastructure.
- Bypass, circumvent or attempt to bypass or circumvent any measures we may use to prevent or restrict access to the Services.
- Encourage or assist any third party to do any of the above.
6. Intellectual property
All rights, title and interest in and to the Services, including all related intellectual property rights (copyright, trademark, patent, design rights, database rights, trade secrets and know-how), are and will remain the exclusive property of Dasitaike and its licensors.
The trademarks, service marks, logos and trade names displayed on the Services (including "Dasitaike" and the Dasitaike logo) are protected trademarks of Dasitaike. You may not use them without our prior written consent.
Feedback you provide to us may be used, reproduced and distributed by us without restriction or compensation to you.
7. User content
You may submit content to the Services, including reviews, comments, support tickets, in-app messages, photos, files and other materials ("User Content"). You retain ownership of your User Content, but you grant Dasitaike a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, distribute, prepare derivative works of, display and perform the User Content in connection with operating and improving the Services.
You represent and warrant that you own or have the necessary rights to your User Content, and that your User Content does not violate the rights of any third party or any applicable law.
We may remove or restrict access to User Content that we reasonably believe violates these Terms, applicable law, or the rights of any third party.
8. Purchases, quotes & trade
Quoted prices, lead times, minimum order quantities (MOQs) and other commercial terms are valid for the period stated in the quote and may be revised after that period. Orders are subject to written acceptance by Dasitaike and to continued credit approval for trade customers.
Payment terms, accepted methods, late-payment interest and other payment-related terms are set out in the relevant invoice or trade agreement. We may charge interest on overdue amounts at the maximum rate permitted by law.
Title and risk of loss pass to you in accordance with the agreed Incoterms (2020). For consumer purchases, title and risk pass upon delivery to the address you provide, unless local law provides otherwise.
We may refuse orders that appear to be fraudulent, that violate sanctions or export controls, or that are prohibited in your jurisdiction.
9. App store terms
9.1 Google Play
Our Apps are downloaded from Google Play under the Google Play Terms of Service. Your use of the Apps is also subject to the Google Play Developer Program Policies, including (where applicable):
- User Data Policy
- Families Policy (including the "Designed for Families" program)
- Ads Policy (placement, frequency, rewarded ad disclosure)
- Permissions Policy
- SDK Policy
- Impersonation Policy
- Monetization Policy
- Store Listing & Promotion Policy
- Spam & Placement in the Store Policy
Google is not a party to these Terms and is not responsible for the Apps or for any maintenance or support. Google may suspend, remove or restrict the Apps for any reason under its policies. Any liability arising from your use of the Apps is governed by these Terms, not the Google Play Terms of Service.
9.2 Apple App Store
Our Apps are downloaded from the Apple App Store under the Apple Media Services Terms and Conditions. Your use of the Apps is also subject to the App Store Review Guidelines and the Apple Developer Program License Agreement. Specifically:
- You acknowledge that these Terms are between you and Dasitaike, not with Apple.
- Apple has no obligation to provide any maintenance or support for the Apps.
- In the event of a failure of an App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Apps.
- Apple is not responsible for any claim by you or any third party relating to the Apps or your possession or use of the Apps, including product liability, legal or regulatory compliance, and intellectual property infringement.
- You represent and warrant that (a) you are not located in a region that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- For Apps in the Kids category or Apps subject to the Apple age-gating framework, additional rules apply (see Section 16).
10. Advertising & in-app purchases
Our Apps and Website may display advertising delivered through the ad networks listed in our Privacy Policy. By using the Services you agree that we may display such advertising, subject to your consent settings, your device's "Limit Ad Tracking" / "Ask App Not To Track" preferences, the App Tracking Transparency framework on iOS, and the policies of the relevant app store.
Ad units we use include splash (open), rewarded video, interstitial and banner ads. Frequency caps, child-directed treatment and the consent layer are described in detail in the Privacy Policy.
You may support us by purchasing in-app items or subscriptions. In-app purchases are processed by the relevant app store and are subject to its terms in addition to these Terms. Where required by local law, you may have additional rights to withdraw from a digital content purchase — see Section 13.
11. Subscriptions & auto-renewal
Some of our Services are offered on a subscription basis. Subscriptions automatically renew for the period stated at the time of purchase (typically monthly or annually) unless you cancel at least 24 hours before the end of the current period.
Subscriptions are managed through the relevant app store (Google Play or the Apple App Store). To cancel a subscription:
- On Google Play: open the Play Store → tap your profile → Payments & subscriptions → Subscriptions → select the subscription → Cancel.
- On Apple: open Settings → tap your name → Subscriptions → select the subscription → Cancel.
If you cancel a subscription, you will continue to have access to the paid features until the end of the current billing period. Deleting the App does not cancel your subscription.
We may change subscription prices with reasonable prior notice. If you do not agree to a price change, you may cancel before the change takes effect.
12. Free trials & promotional offers
We may offer free trials, introductory pricing, or other promotional offers. Free trials automatically convert to paid subscriptions at the end of the trial period unless you cancel before the end of the trial. We will notify you in advance of any conversion to a paid subscription, as required by the relevant app store.
Eligibility for promotional offers may be limited (for example, one per person, one per device, one per household, or limited to new customers). We may revoke promotional pricing where we reasonably believe the rules have been violated.
13. Refunds, returns & warranty
13.1 Consumer products
Subject to applicable consumer protection law, you may have the right to:
- A 14-day right of withdrawal for distance contracts in the EEA, the UK and several other jurisdictions.
- A right of withdrawal within 30 days of delivery under U.S. retailer policies where applicable.
- A right of withdrawal within 7 days of delivery under Australian Consumer Law in certain circumstances.
- A cooling-off period under Brazil's CDC (Código de Defesa do Consumidor).
To exercise a right of withdrawal, contact support@dasitktech.com with your order number. You are responsible for the cost of returning the goods unless the goods are faulty, not as described or subject to a recall.
13.2 Digital content & subscriptions
Where local law provides a withdrawal right for digital content, you agree that the content may be made available to you immediately upon purchase, and you acknowledge that you may lose your right of withdrawal once the content has been fully delivered. We will surface this consent at the time of purchase as required by the relevant app store.
13.3 Warranty
Consumer products come with warranties that cannot be excluded under applicable law (for example, the implied warranties of merchantability and fitness for purpose under U.S. law, the statutory warranty under the EU Sale of Goods Directive, and the consumer guarantees under Australian Consumer Law). Specific warranty periods and exclusions are described in the product documentation.
14. Shipping, customs & sanctions
We ship to the destinations listed on our Website. We comply with the export control and sanctions laws of Hong Kong, the United States, the European Union, the United Kingdom, the United Nations and other applicable jurisdictions. By placing an order you represent and warrant that:
- You are not located in, or a resident or national of, a country or region that is subject to comprehensive sanctions.
- You are not on any list of prohibited or restricted parties maintained by the U.S. Treasury (OFAC), the U.S. Commerce (BIS Entity List / Denied Persons List), the EU, the UK, the UN or any other relevant authority.
- The goods you order are not intended for a prohibited end-use (including military end-use where restricted, or use in connection with weapons of mass destruction).
You are responsible for any import duties, taxes and customs clearance in your country, unless we have expressly agreed to a DDP (Delivered Duty Paid) arrangement. We are not responsible for delays caused by customs authorities.
15. Regional & country terms
15.1 United States
The Services are offered by Hong Kong Dasitaike Electronics Technology Co., Limited, with its principal place of business in Hong Kong. The Services are not subject to U.S. jurisdiction in all respects. U.S. consumers retain the protections of their state and federal consumer protection laws, including (where applicable) the right to opt out of the sale of personal information under the CCPA/CPRA.
15.2 European Economic Area, United Kingdom, Switzerland
Consumers in the EEA, the UK and Switzerland have the benefit of mandatory consumer protection laws, including the Consumer Rights Directive, the Sale of Goods Directive, the Digital Content Directive, the Omnibus Directive, and (in the UK) the Consumer Rights Act 2015. Nothing in these Terms limits or overrides those rights.
15.3 China (Mainland)
For users in mainland China, additional disclosures required under PIPL and the related administrative measures are provided in our Privacy Policy.
15.4 Brazil
Consumers in Brazil are protected by the Código de Defesa do Consumidor (CDC). Cancellation rights, the right of withdrawal, the right to clear information, and the prohibition of abusive clauses are all preserved.
15.5 Japan
Consumers in Japan are protected by the Act on Specified Commercial Transactions and the Consumer Contract Act. The right of withdrawal, the prohibition of unfair contract terms, and the cooling-off period for door-to-door and telemarketing sales are preserved.
15.6 South Korea
Consumers in South Korea are protected by the Act on Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, and the Personal Information Protection Act. The right of withdrawal for distance contracts, the prohibition of unfair terms, and the rules on personal data are preserved.
15.7 Australia & New Zealand
Consumers in Australia and New Zealand are protected by the Australian Consumer Law and the New Zealand Consumer Guarantees Act. Goods come with guarantees that cannot be excluded.
15.8 Singapore, Malaysia, Thailand, Vietnam, Indonesia, the Philippines
Consumers in these jurisdictions are protected by the relevant consumer protection and e-commerce laws. Where mandatory local rules conflict with these Terms, the local rules prevail.
15.9 Middle East & North Africa
Where we offer services in MENA jurisdictions, the terms comply with the relevant local consumer protection, data protection and e-commerce laws, including (where applicable) the UAE Federal Law No. 15 of 2020, the UAE Personal Data Protection Law, the Saudi Personal Data Protection Law, the Saudi E-Commerce Law, and the relevant Egyptian, Moroccan and Tunisian regulations.
15.10 India
Consumers in India are protected by the Consumer Protection Act 2019, the Information Technology Act 2000, the Information Technology (Reasonable Security Practices and Procedures) Rules 2011, and (where in force) the Digital Personal Data Protection Act 2023.
16. Children & minors
Our Services are not directed at children under the age of digital consent (see Section 2). Where our Apps are designed for or may be of interest to children, we apply the strictest protections required by law and by the relevant app store.
16.1 Google Play — Designed for Families & Families Policy
Apps designed for children are required to:
- Disable personalized advertising and any interest-based advertising.
- Disable third-party remarketing.
- Disable third-party analytics whose ToS are inconsistent with the Families Policy.
- Not transmit Android Advertising ID, device serial number, Wi-Fi MAC address or other persistent identifiers off the device except for the limited purposes permitted under the Families Policy.
- Use only SDKs that have been independently certified as Families Policy compliant for use in child-directed Apps.
- Display clear disclosures about any in-app purchases and obtain verifiable parental consent for purchases.
16.2 Apple App Store — Kids Category
Apps in the Apple Kids category must:
- Not include behavioral advertising.
- Not include third-party analytics.
- Not include third-party advertising networks whose ToS are inconsistent with the Kids category rules.
- Not transmit personally identifiable information or device identifiers to third parties.
- Not include links that take the user out of the app or purchasing opportunities outside the app.
- Include a privacy policy that accurately describes the App's data practices.
16.3 Parental controls
Where the platform provides parental control tools (for example, Apple Screen Time, Google Family Link, Android Digital Wellbeing, Samsung Kids), we respect the settings chosen by parents and guardians.
17. AI & automated features
Some of our Services include AI-driven features (recommendations, predictive analytics, image or text generation, translation, and similar). Where AI is used, we:
- Disclose the use of AI in the feature UI and in our Privacy Policy.
- Apply human review where required by law or by our internal policy.
- Implement safeguards to reduce the risk of harmful, biased or misleading output.
- Allow you to opt out of AI-driven personalization where technically feasible, and to use a non-AI alternative where one exists.
AI-generated output may not be accurate or appropriate for your use case. You are responsible for reviewing AI output before relying on it.
18. Third-party services & links
The Services may contain links to third-party websites, products or services that we do not own or control. We are not responsible for the content, policies or practices of any third party. Your use of any third-party service is at your own risk and subject to the third party's own terms and policies.
19. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment.
We do not warrant that the Services will be uninterrupted, error-free, secure or free of harmful components, or that defects will be corrected.
Nothing in these Terms is intended to exclude or limit any warranty or right that cannot be excluded or limited under the mandatory laws of your jurisdiction (for example, the consumer guarantees under the Australian Consumer Law, the statutory warranty under the EU Sale of Goods Directive, and the implied warranties under the U.S. Uniform Commercial Code as applied to consumers).
20. Limitation of liability
To the maximum extent permitted by law, in no event will Dasitaike, its affiliates, officers, directors, employees, agents, suppliers or licensors be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, including damages for loss of profits, revenue, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of, or inability to use, the Services, even if we have been advised of the possibility of such damages.
Where liability cannot be excluded, our aggregate liability for any claim arising out of or relating to the Services is limited to the greater of (a) the amount you paid us for the Service in the 12 months immediately preceding the claim, or (b) USD 100.
Nothing in these Terms limits liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be excluded or limited under applicable law.
21. Indemnification
You agree to indemnify, defend and hold harmless Dasitaike, its affiliates, officers, directors, employees, agents, suppliers and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys' fees) arising out of or relating to (a) your violation of these Terms, (b) your User Content, (c) your use of the Services, or (d) your violation of any applicable law or the rights of a third party.
22. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we reasonably believe that you have violated these Terms, that continued provision would create a security or legal risk, or that an app store or regulator has required us to do so.
You may stop using the Services at any time and may delete your account in accordance with the in-app account deletion flow or by emailing support@dasitktech.com.
The following sections survive termination: Intellectual Property, User Content, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and any other provision that by its nature should survive.
23. Governing law & disputes
These Terms are governed by the laws of Hong Kong SAR, without regard to conflict of laws principles.
Nothing in this section limits your right to bring a claim in the courts of your country of residence under mandatory local consumer protection law. Where you are a consumer in the EEA, the UK or another jurisdiction with mandatory consumer protection rules, those rules prevail over this choice of law to the extent of any conflict.
We will attempt to resolve any dispute informally first. If a dispute cannot be resolved informally, it will be subject to the exclusive jurisdiction of the courts of Hong Kong, except for claims that may be brought in the small claims court of your place of residence.
For consumers in the EEA, the European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr. For consumers in the UK, the relevant Alternative Dispute Resolution providers are listed at gov.uk/consumer/consumer-contracts/alternative-dispute-resolution.
24. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated in advance through the Website or by email (where you have provided one and consented to marketing communications). The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Services after a material change constitutes acceptance of the updated Terms; if you do not agree, please stop using the Services.
